Effective Date: 18 November 2025 Welcome to Deep Breath Institute. These Terms of Service govern your use of our training services, facilities, and website. By enrolling in our courses or using our services, you agree to these terms.

Deep Breath Institute provides accredited and non-accredited First Aid, CPR, Healthcare training, NDIS support services, and breath-hold training programs in partnership with Allens Training Registered Training Organisation 90909.

2. Service Offerings

We provide: – Nationally recognised First Aid and CPR training courses – NDIS support worker services and inclusive training programs – Breath-hold training (Surf Apnea courses) – Customised workplace training and assessments – On-location and facility-based training sessions All courses are delivered in accordance with relevant Australian training package requirements and regulatory standards in partnership with Allens Training RTO 90909

3. Enrolment and Eligibility

3.1 Enrolment Process

  • Enrolment is confirmed upon payment and completion of required pre-course documentation
  • You must provide accurate and complete information during enrolment
  • We reserve the right to refuse enrolment at our discretion

3.2 Eligibility Requirements

  • Participants must meet minimum age requirements for specific courses (typically 14+ years)
  • Physical and cognitive ability to perform practical assessments may be required
  • Special accommodations can be arranged for NDIS participants and those requiring accessibility support

4. Fees and Payment

4.1 Course Fees

  • All fees are displayed in Australian Dollars (AUD) and include GST where applicable
  • Payment is required at the time of booking unless alternative arrangements are agreed in writing
  • Group and corporate bookings may be invoiced with agreed payment terms

4.2 Payment Methods

We accept credit/debit cards, bank transfers, and other methods as specified during booking.

5. Cancellations and Refunds

5.1 Participant Cancellations

  • More than 7 days before course: Free transfer to another date
  • 3-7 days before course: 50% refund or free transfer to another date
  • Less than 3 days before course: No refund; transfer available for a $50 fee
  • No-show: No refund or transfer

5.2 Deep Breath Institute Cancellations

If we cancel a course due to insufficient enrolments, instructor unavailability, or unforeseen circumstances, you will receive: – Full refund, or – Transfer to an alternative date at no additional cost

5.3 Exceptional Circumstances

We may consider refunds or transfers outside these terms for medical emergencies or compassionate grounds (documentation may be required).

6. Course Attendance and Completion

6.1 Attendance Requirements

  • Full attendance is mandatory for certification
  • Late arrival or early departure may result in non-completion
  • You must actively participate in all practical and theoretical components

6.2 Assessment and Certification

  • You must demonstrate competency in all required assessment tasks
  • Free resits are available with additional coaching if needed
  • Certificates are issued on the day of successful completion (digital copies provided)
  • Certificates are valid for the period specified by the relevant training package

6.3 Conduct Expectations

Participants must: – Treat instructors and other participants with respect – Follow safety instructions and facility rules -Not attend under the influence of drugs or alcohol – Not engage in disruptive, discriminatory, or unsafe behaviour We reserve the right to remove participants who breach these expectations without refund.

7. Health and Safety

7.1 Pre-Course Health Disclosure

You must disclose any medical conditions, injuries, or limitations that may affect your ability to participate safely. This information is kept confidential and used only to provide appropriate support.

7.2 Assumption of Risk

Training involves physical activity and simulated emergency scenarios. While we take all reasonable precautions, you participate at your own risk.

7.3 Insurance

We maintain appropriate public liability insurance. Participants are responsible for their own personal accident and health insurance.

8. Intellectual Property

8.1 Course Materials

All training materials, resources, and content provided by Deep Breath Institute are our intellectual property or licensed for our use. You may: – Use materials for personal learning and reference – Not reproduce, distribute, or commercially exploit materials without written permission

8.2 Photography and Recording

We may photograph or record training sessions for promotional, quality assurance, or educational purposes. By enrolling, you consent to this use unless you notify us in writing. You may opt out at any time.

9. Privacy and Data Protection

Your personal information is collected, used, and stored in accordance with our Privacy Policy and the Australian Privacy Principles. Please review our Privacy Policy for full details.

10. Limitation of Liability

10.1 Service Delivery

We strive to deliver high-quality training but do not guarantee specific outcomes or employment results from course completion.

10.2 Liability Limits

To the maximum extent permitted by law, Deep Breath Institute is not liable for: – Indirect, consequential, or incidental damages – Loss of income, opportunity, or data – Damages exceeding the fees paid for the relevant service

10.3 Consumer Law

Nothing in these terms excludes or limits rights under the Australian Consumer Law that cannot be excluded or limited.

11. Website Use

11.1 Acceptable Use

You agree to use our website lawfully and not to: – Attempt unauthorised access to systems or data – Transmit harmful code or malware – Scrape, copy, or misuse website content – Impersonate others or provide false information

12. NDIS Services

12.1 NDIS Participants

Services provided to NDIS participants are delivered in accordance with NDIS Practice Standards and the NDIS Code of Conduct.

12.2 Service Agreements

Specific terms for NDIS support services are outlined in individual Service Agreements, which take precedence over these general terms where applicable.

13. Complaints and Disputes

13.1 Complaints Process

If you have a concern or complaint: 1. Contact us directly via email or phone 2. We will acknowledge your complaint within 2 business days 3. We aim to resolve complaints within 14 days 4. Formal complaints are handled in accordance with Allens Training RTO 90909 complaints and appeals policy

13.2 External Resolution

If we cannot resolve a dispute internally, you may seek assistance from: – Australian Skills Quality Authority (ASQA) for training-related matters – Office of the Australian Information Commissioner for privacy concerns – Relevant consumer protection agencies

14. Changes to Terms

We may update these Terms of Service from time to time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the new terms.

15. Governing Law

These Terms of Service are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the Queensland courts.
